Divorce in Utah
In Utah, a divorce can be granted on the basis of irreconcilable differences or an unworkable marriage. This is sometimes referred to as a no-fault divorce. Divorce can also be granted on grounds of marital misconduct or fault of one of the parties.
During a divorce, the court will:
- Determine custody of any minor children
- Establish child support and parent time
- Divide property
- Assign debts
- Make other appropriate orders depending on the circumstances of each party
Utah law requires both parents to attend divorce education and orientation classes when minor children are involved in the case. The divorce orientation class is offered online. There is also an optional class specifically designed for children of divorcing parents.
Legal Separation: An Alternative to Divorce
At Lokken & Associates, P.C., we also assist individuals with obtaining a legal separation. What is the difference between a legal separation and a divorce? Spouses remain married in a legal separation, but they no longer live together. This may be an option for couples who want to separate on a trial basis to determine if divorce is the best solution for their marital difficulties. Clients may also choose legal separation over divorce for religious or financial reasons.
