Protecting Your Parental Rights
Fathers face unique struggles in the family law courts. Only recently have the laws changed to give both parents equal parental rights. There is still a stigma against men in family law courts, but fathers are entitled to establish positive relationships with their children. At Lokken & Putnam, P.C., we fight to let fathers throughout Salt Lake City, Cottonwood Heights, and all of Utah play an active role in their child's life.

How Does a Father Establish Paternity in Utah?
In Utah, fathers have different rights depending on whether or not they are married to the mother of the child. When a child is born to married parents, paternity is automatically established. Married fathers have the right to make decisions regarding legal, educational, health, religious, and welfare matters. However, unmarried fathers will face a few legal challenges when it comes to establishing paternity.
Unmarried fathers must prove paternity in one of two ways:
1) Taking a paternity test
2) Signing a Voluntary Declaration of Paternity
If there are any doubts over paternity, coming from either the mother or father, the father must take a paternity test. If the paternity test proves a biological connection, paternity is automatically established and the father has the right to file for child custody and visitation. The mother will then be able to file for child support.
Helping Fathers with Custody & Parent Time Disputes
While fathers may assume that they will not get primary or sole custody of their child, the law states that the court must view both parents as equals. We help fathers establish paternity so that they can apply for custody.
