Visitation

Who can be granted Parent-time or Visitation Rights?

Those parents who are not awarded physical custody of their children may be entitled to parent-time rights. There are several different parent-time arrangements that can be made, depending on the circumstances of the parties:

Reasonable parent-time - a type of visitation in which reasonable times and places are determined by both parents.

Fixed parent-time - a type of visitation in which the court orders times and places for visitation.

Supervised parent-time - a type of visitation in which an adult supervisor must be present.

Standard parent-time - visitation determined by law as the minimum amount a non-custodial parent should be entitled to.

Minimum schedule for parent-time for children under five years of age.

Minimum schedule for parent-time for children 5 to 18 years of age.

In addition to the non-custodial parent being awarded visitation rights, there has been precedent for grandparents being awarded visitation. This issue is still hotly debated in the legal community.

If you or someone you love is going through a child custody battle, you may want to contact one of our family law attorneys for more information.
