Alimony

Another issue to be resolved upon divorce is alimony. Alimony may be paid from one spouse for support of the other spouse after a divorce or during a separation. There are two types of alimony:

Permanent alimony - alimony awarded after a divorce consisting of regular payments that may change or end if the receiving party remarries or cohabitates.

Temporary alimony - alimony awarded during divorce proceedings or separation consisting of regular payments that include money for divorce costs and money for daily living. Temporary alimony is paid until the court has made a determination on permanent alimony.

Although most alimony payments are made from the husband to the wife, in instances where the husband stays home and takes care of the home and children, the wife may be required to pay alimony.

Alimony is based on several factors - the need of the recipient spouse, the ability of the recipient spouse to earn income, the ability of the payor spouse to pay, the length of the marriage, and the lifestyle that the parties were accustomed to. Fault of the divorce may also be considered.
